1. New Definitions: The amendment formally establishes definitions for "Genetically Modified" and "Unintentional Mixing" (or Adventitious Presence), providing a clearer legal foundation for subsequent regulations.
 
2. Mandatory GM Labeling Scope: Foods falling under the following categories will require clear genetically modified labeling:
 
  • Foods produced or processed using GM agricultural, livestock, or aquatic products as raw materials.
  • Foods where the unintentional mixing of GM ingredients exceeds a specific threshold determined by the Ministry of Food and Drug Safety (MFDS), even if non-GM raw materials were primarily used.
3. "Non-GM" Labeling Permissions: Products may be labeled as non-genetically modified if they meet these criteria:
  • They contain no GM agricultural, livestock, or aquatic product raw materials.
  • Any unintentional presence of GM material is within the compliance limit set by the MFDS.
4. Penalties for Non-Compliance: The revised law outlines penalty provisions for violations of these new labeling requirements, underscoring the importance of adherence for all stakeholders in the food industry.
